Albany Police Department Incident #04-23509

On Monday, September 27, 2004 at 0833 hours officers from the Albany Police Department responded to the Los Dos Amigos Hacienda restaurant, 2133 Santiam Highway SE, Albany, Oregon, regarding a reported suspicious circumstance.  At the location, officers contacted two adult female subjects that alleged they were the victim of theft.  In addition, they reported that they felt as if they were unwittingly drugged and disrobed while in their vehicle.  The victims had spent the evening in their vehicle in the restaurant parking lot on Sunday, September 26, 2004.  A small amount of money was stolen from the victims. 

On Friday, October 1, 2004, detectives from the Albany Police Department, aided by investigators from the Oregon Liquor Control Commission continued this investigation.  The investigation determined that no sexual assault occurred.  At 1400 hours detectives arrested Ernesto Galindo-Mora, 31 years of age, the Manager of the Los Dos Amigos Hacienda restaurant for the below listed crimes:

  1. Recklessly Endangering (2 Counts) ORS 163.195
  2. Selling Alcohol without a Permit ORS 471.360 (1)(A)
  3. Providing Alcohol to a Minor ORS 471.410 (2)
  4. Minor Service Permitee ORS 471.482

Ernesto Galindo-Mora was lodged in the Linn County Jail.

At 1540 hours detectives arrested Rene Marquez, a 20 year old, bartender for Los Dos Amigos Hacienda restaurant on the below listed charges:

  1. Recklessly Endangering (2 Counts) ORS 163.195
  2. Theft in the Third Degree ORS 164.043
  3. Providing Alcohol to an Intoxicated Person (2 Counts) ORS 471.410 (2)

Information learned through this investigation is that Rene Marquez was the on-duty bartender with the restaurant.  He allegedly added a substantial quantity of alcohol to the victim’s drinks without their consent.  Rene Marquez was performing duties as a bartender, despite the fact that he was underage.  He was cited for Minor in Possession of an Alcoholic Beverage, in addition to being arrested for the aforementioned crimes.

The owner of the Los Dos Amigos Hacienda restaurant, Rafael Mora, is cooperating with the Albany Police Department and Oregon Liquor Control Commission.  He has chosen to voluntarily close the Los Dos Amigos Hacienda, 2133 Santiam Highway SE, for seven days pending the outcome of the investigation.  The investigation is continuing.  Anyone with information regarding this incident is encouraged to contact the Albany Police Department, Detective Section at (541) 917-7686
